BIKAJI X PAYTM CASHBACK OFFER

PART A – DETAILED TERMS AND CONDITIONS OF THE OFFER

The ‘Bikaji x PayTM’ Cashback Offer ('Offer') is being jointly organized by Bikaji Foods International Limited, having its registered office at F 196 -199, F 178 & E 188, Bichhwal Industrial Area, Bikaner, Rajasthan – 334004, India and the corporate office at Plot No. E-558-561, C-569-572, E-573-577, F-585-592, Karni Extension, RIICO Industrial Area, Bikaner, Rajasthan – 334004, India (hereinafter referred to as “Bikaji”) and One 97 Communications Limited, having its registered office at First Floor, Devika Tower Nehru Place, New Delhi – 110019, India (hereinafter referred to as “One 97/ Paytm”) a company which owns and operates an online marketplace on the website located at the URL: ‘www.paytm.com’ and Paytm mobile application (hereinafter “Paytm Platform”). One97 and Bikaji, shall collectively be referred to as the “Organizers”.
This Offer is valid on specific Bikaji product categories and pack sizes as marked as the ‘Promotional Packs’ (as detailed below) by Bikaji for this Offer and only such products shall be eligible for cashback under this Offer. BIKAJI reserves the sole right to determine, modify or withdraw the eligible Promotional Packs at any time, without any prior notice.

Participation in this Offer is optional. The Customers are not bound in any way to participate in this Offer. Product may also be available for purchase, without this Offer or any promotional benefit.
The terms and conditions mentioned herein govern your participation in the Offer, facilitated by Paytm. By participating in the Offer, you (hereinafter referred to as “Participant/ User/ Customer”) shall be deemed to have read, understood and unconditionally accepted the terms and conditions of the Offer and further agree to be irrevocably bound by these Terms & Conditions (including any modification, amendment or variations to the same made by Paytm without prior notice.
To participate in this Offer and be eligible to earn the Cashback, the Participant needs to purchase a Promotional Product Pack with the Paytm Cashback logo on its packaging and follow the below steps.

STEPS TO PARTICIPATE:

Step 1: Buy a Bikaji Promotional Product Pack, bearing the Paytm Cashback logo on its packaging.

Step 2: Scan the QR code on the pack, which will take the Customer to the promotion/Offer page on Paytm App through one of the options below.

Option 1: Existing Paytm Customers can scan the QR code using Paytm Scanner printed on the front of the Promotional Product Pack.
Option 2: New Customers to Paytm need to use their phone’s camera app to scan the QR code printed on the Promotional Product Pack, which will redirect them to App Store (for iOS) or Play Store (for Android) to download the app. Download the Paytm App, upon installation, register on the App using the same mobile number as provided in your bank account. Participant need to link his/ her bank account within the app, to activate the services to use Paytm App.

Step 3: Check the tick box option to voluntarily consent to share Customer details i.e. Name of Customer, Customer’s mobile number, Customer’s last known location (as captured by the Paytm App), with Bikaji for marketing, advertising, publicity and promotional purpose, only as per applicable data privacy laws in India, including but not limited to, Information Technology Act, 2000and Digital Personal Data Protection Act, 2023 (upon became fully enforceable). Such usage and disclosure shall be without any additional compensation, consideration or further notice to the Participants and shall be subject to applicable laws and respective privacy policies of Paytm. If the Customer authorises to share their information, only then Paytm will share the information with Bikaji. If Customers are not comfortable in sharing their details, they may choose to opt out this promotion.

Step 4: Participant must complete 1 valid transaction as shown in the next page. Choose any one transaction which you need to carry out immediately as per your need.

Step 5: Upon successful completion of the transaction, you will receive a scratch card in the “Cashback and Rewards” section of your Paytm App. Participant need to scratch the scratch card and redeem the reward within 15 days of receiving the scratch card, failing which, reward will expire automatically.

Note: INR 10 is the maximum amount of Cashback that may be received by an individual Participant under this Offer. It’s a randomised, automated reward mechanism, which is being run by algorithm and governed by strict system rules. No human intervention is involved in awarding the cashback amount.

This Offer is valid in India from August 13, 2025 till January 15, 2026 (both dates inclusive) or till stocks last or product expiry date, whichever is earlier.
Offer can be accessed only on the latest version of the Paytm App and it’s the responsibility of Participant to ensure their device is compatible with Paytm App and they are using most updated version. Bikaji and Paytm shall not be responsible for any technical or device-related issues that prevent access to or redemption of the Offer.
The Offer is valid only once per User per mobile number during the Offer Period, irrespective of the number of Promotional Product Packs purchased.
New User must use their phone’s camera app to scan the QR code printed on the Promotional Product Pack. It will redirect the User to either Play Store or App Store based on the handset. User needs to download the Paytm App and upon installation, register with the same mobile number which is used in bank account. Once registered on Paytm App, it will automatically direct the User to the landing page and User need not to scan the QR code to resume their journey.
New User will be eligible to receive a maximum cashback of INR 10, subject to the successful completion of 1 qualifying transaction through Paytm App during this Offer Period.
Qualifying transactions include the following:

First Transaction - UPI Money transfer to friends, family or any merchant (P2P or P2M);
Second Transaction -Travel ticket booking via Paytm App.

Existing users with an active UPI linked account on Paytm App will receive a maximum cashback upto INR 10 upon successful completion of 1 abovementioned qualifying transaction, as defined and validated solely by Paytm.
The first Cashback will be provided when the Customers successfully carry out UPI led transaction through Paytm App. However, while doing transaction second time using the QR code printed on the Promotional Product Pack, Customer will be shown by the Paytm, the category Offers of Travel, and they will be gratified accordingly, as per the Paytm’s rules and policies.
The scratch card issued under this Offer to the Participants will expire after `15 days from the date of its issuance. After expiry, the scratch cards shall be deemed void and non-redeemable and no requests for extension or re-issuance will be entertained. Bikaji and Paytm is not responsible for any scratch card expiry, access failure or any delay, in this regard.
The Cashback reward earned by the Participant upon scratching the scratch card, will be credited in the Paytm UPI linked account of the Participant within 72 hours.
The minimum qualifying amount in a transaction is determined by applicable law, banking/ payment system rules and regulations, specific merchant terms, and/or Paytm terms. Such condition would be informed while carrying out the transaction, which may vary from product to product and Bikaji and Paytm has no control over this condition and shall not be liable for any ineligibility, due to non-fulfilment of threshold.
Participant(s) can only use one unique set of Paytm credentials to participate and qualify for this Offer. Any of these unique Paytm credentials must not have been used, duplicated or shared to register another Paytm account and any misuse or fraudulent activity shall be subject to disqualification and neither Bikaji, nor Paytm shall bear any responsibility or obligation in such cases.
Participant(s) acknowledge that they shall be solely responsible for deciding if the product or service purchased is suitable or relevant for them, based on their individual circumstances and personal judgement.
This Offer does not constitute Paytm’s endorsement/ recommendation of a Bikaji’s products or services.
Participant(s) understand and agree that Paytm shall not be responsible for any merchant services or products referenced in this Offer or the scratch card reward, or that they purchase or receive from a merchant or other third party. The role of Bikaji is strictly limited to the manufacturing and sale of Promotional Product Packs bearing Paytm Cashback Offer logo and the role of Paytm is only limited to provide Offer and Cashback to the Customers, who purchase the Promotional Product Packs and avail Offer as per the Offer terms and conditions mentioned herein. Any complaints/queries relating to the merchant’s product shall be directly taken up with the merchant as per the details on the Promotional Product Packs. Bikaji shall not, in any manner, whatsoever, be held responsible or liable for Cashback rewards, digital transaction processing, system functionality, qualifying transaction requirements or any other features, terms or services facilitated by Paytm in connection with this Offer. Any complaints/queries relating to Paytm App and its services shall be addressed exclusively to Paytm’s Help and Support section and Bikaji shall not entertain or responsible for any such issues or claims. Participation in this Offer shall be deemed an acknowledgment and acceptance of limited role of Paytm and Bikaji. Paytm and Bikaji shall not be liable for any Participant’s claim with regard to the products and services offered by the other Party.
In addition to these terms and conditions, the Participant shall at all times be bound by the terms and conditions as imposed by Paytm on usage of its app, microsites, purchase of services etc.
Paytm shall not be responsible for failure to provide the Cashback to the Participant(s) for any downtime on the services, caused due to technical or other factors attributable at the end of Paytm that may occur for reasons including but not limited to failure of hardware equipment, configuration issue, decisions, change in marketing plans and/ or changes in regulations that are carried out by any judicial or quasi-judicial or regulatory body.
Participants agree and confirm that their participation in the Offer constitutes their understanding of and unconditional agreement to these Offer terms and conditions. All applicable charges, taxes and expenses and costs associated to participate in this Offer such as purchase of Promotional Product Pack, internet charges for participation, any incidental expenses, etc., shall be borne solely by the Participant.
This Offer cannot be combined or clubbed/used or claimed in conjunction/alongside with any prevailing Offer/ Scheme/ promotion(s) available on Paytm Platform. Further the Offer is non-transferable, non-encashable, non-refundable, in any manner.
The Cashback received by the Participant under this Offer is non-transferrable, non-assignable and cannot be exchanged for cash or any other form of benefit and no requests for substitution or conversion shall be entertained.
The Offer is being made purely on a "best effort" basis and is valid during Offer Period only or until stocks last, whichever is earlier.
In cases of suspected or confirmed fraudulent/suspicious or irregular activity or transactions by any Participant, Paytm, in consultation with Bikaji, reserves the right to revoke the offer or cancel (mark ineligible) a transaction and corresponding Cashback or disqualify the Participant, without any obligation to inform such Participant.
Any amendment, modification, change, addition, withdrawal, alteration of any of the terms and conditions of the Offer or termination of this Offer shall be carried out only with the mutual consent and written agreement of both Paytm and Bikaji. In case, if there is any discrepancy, ambiguity or dispute regarding the Offer, the final decision shall be taken jointly by Paytm and Bikaji and such decision shall be final and binding on the Parties. Neither Paytm, nor Bikaji shall have any liability towards any Participant for any indirect, incidental, or consequential claims arising out of participation in the Offer, beyond the scope expressly stated herein.
Any decision to disqualify any Participant or reject the redemption, or take action in the event of failure or breach or non-adherence to the T&C of the Offer by the Participant, shall be taken in consultation with Bikaji.
All decision regarding the Offer, eligibility, participation, redemption, interpretation of terms and any other matter relating to the Offer shall be taken jointly by Paytm and Bikaji and such decisions shall be final and binding on all Participants.
Any correspondence, grievance or query with regard to the Cashback/Redemption process and/or usage of Paytm App shall be addressed directly with Paytm at the “Help and Support” section of the Paytm App. Further, Bikaji shall not be responsible or liable in any manner for issues arising from Cashback processing, redemption failure, Paytm App errors that are solely attributable to Paytm. Conversely, Paytm shall not be responsible or liable for any defect and/or deficiency in the Product(s) manufactured and offered by Bikaji. Bikaji shall be solely liable and responsible for addressing the Customer issues, queries, concerns, disputes, claims related to Bikaji’s Products and Promotional Product Packs. Bikaji’s Customer Care details are clearly printed on the product packaging of the Promotional Product Pack.
Paytm does not endorse the quality of the Products being offered by Bikaji, any complaints or queries pertaining to the Product packs offered by Bikaji would be taken up directly with Bikaji.
At the end of the Offer Period, all obligations of both Paytm or Bikaji (as applicable) in regard to the Offer will terminate.

ELIGIBILITY TO PARTICIPATE:

This Offer is open only to natural persons, who are Indian citizens, residing in India, and are above 18 years of age only, as on the date of participation. Participation by minors is strictly prohibited and shall be deemed void.
Employees, officers, interns, contractors, and office-holders of One 97 Communications Limited (Paytm) and/or Bikaji, their immediate family members, as well as Paytm’s or Bikaji’s affiliates and subsidiaries, distributors and any representatives or agencies of One 97 Communications Limited (Paytm) and/or Bikaji or other persons professionally connected with the administration and execution of this Offer, are not eligible to participate.
To participate in the Offer, the Participant needs to have a registered and active account on Paytm Platform with a verified Indian mobile number on Paytm and such account must not be suspended, blacklisted or flagged for fraud or suspicious activity by Paytm at the time of participation.
Each Participant shall use only 1 unique Paytm account to participate in this Offer. Multiple entries or attempts to participate using multiple mobile numbers, accounts or false credentials shall result in immediate disqualification from Offer without any notice.
The Participant represents and warrants that all information provided by them during participation is true, correct and upto date and they shall not impersonate another person, use fake identities or misuse the Offer platform in any manner.
Bikaji and Paytm reserve the right to disqualify any entry or participation that, in their sole discretion and mutual consultation, is found to be non-compliant with these eligibility criteria or otherwise, detrimental to fairness, integrity or intent of the Offer.
THE PARTICIPANTS SHALL NOT BE ENTITLED TO PARTICIPATE IN THIS OFFER, WHEREVER THE OFFER IS DECLARED INVALID OR ILLEGAL BY THE COURT OF COMPETENT JURISDICTION OR UNDER ANY APPLICABLE LAW, AND THE PROMO SHALL NOT BE APPLICABLE AND/ OR STANDS WITHDRAWN FORTHWITH IN SUCH JURISDICTION AND IN SUCH CASES, NEITHER PAYTM, NOR BIKAJI SHALL BE LIABLE TO PROVIDE ANY COMPENSATION OR ALTERNATIVE BENEFIT TO PARTICIPANT.

PART B – LEGAL TERMS & CONDITIONS

By participating in this Offer:

Participants hereby give their consent to Paytm to collect, share, use and store Participant’s Personal data, including but not limited to Participant mobile number, Participant last known location, if available and collected through the Paytm App for Paytm’s marketing and promotional purpose, only as per applicable data privacy laws in India, including but not limited to, Information Technology, Act, 2000. Participants hereby authorize Paytm to store their information/data in Paytm servers for a period of 3 years. Such collection, usage, disclosure and storage shall be without any additional compensation, consideration or further notice to the Participants and shall be subject to applicable laws and respective privacy policies of Paytm.
The Participants hereby give their consent to Paytm to collect and share Participant’s details, information, data i.e. Participant’s Name, mobile number, Participant’s last known location (as available and collected through Paytm App) with Bikaji for marketing, advertising, publicity and promotional purpose only as per applicable data privacy laws in India, including but not limited to, Information Technology, Act, 2000 and Digital Personal Data Protection Act, 2023 (upon became fully enforceable).
Participants confirm and hereby waive the applicability of rules and regulations of the National Do Not Call Registry (NDNC) and agrees to receive updates and marketing and promotional messages/ SMS/ E-mail/ Call or other communications for current and future contests, campaigns or offers from Paytm.

Bikaji and/ or Paytm reserves the right to exclude any person from participating in the Offer on grounds, including, not limited to misconduct, misrepresentation, coercion, fraud, deceit or for any other reasons, deemed appropriate. No correspondence or appeals regarding such exclusion from the Participant or their representatives shall be entertained by Bikaji and/ or Paytm.
All material and content contained in Paytm Platform is made available for Participant's personal and non-commercial use only. Any other use of the material/ content on Paytm Platform and/ or any information disseminated by SMS or any other means of communication are strictly prohibited.
The Organizers or their authorised agencies are not under any obligation to entertain/ respond to/ comply with any communication/request/claim requiring the Organizer to provide any proof to any Participant or any other third-party, with respect to seeking information, proof or details of other Participants, their identity, value of Cashback won by other Participants, etc. All such information shall be strictly confidential, proprietary and privileged and shall not be disclosed or shared with any Participant or any other third party, except as specifically directed or mandated by a court of competent jurisdiction or legally empowered regulatory authority under applicable law. Any unauthorized demand for such disclosure shall be immediately rejected, without arising any liability.
SUBJECT TO APPLICABLE LAWS: (A) ALL WARRANTIES OF ANY KIND WHATSOEVER, WHETHER EXPRESS OR IMPLIED, ARE HEREBY EXPRESSLY DISCLAIMED BY THE ORGANIZERS, INCLUDING, BUT NOT LIMITED TO, MEETING OF THE PARTICIPANT'S REQUIREMENTS OR ASPIRATIONS, BE UNINTERRUPTED, TIMELINESS, SECURITY, ERROR-FREE, THE RESULTS OR RELIABILITY OF THE CONTEST/ OFFER, DELAY IN SENDING OR RECEIVING THE SMS OR ANY OTHER COMMUNICATION FOR PARTICIPATING IN THE OFFERS, DELAY IN TIME TAKEN FOR THE PROCESS, OR THE WARRANTY FOR DELIVERY, QUALITY, QUANTITY, MERCHANTABILITY, FITNESS FOR USE OR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY, RELIABILITY OR PERFORMANCE, IN RESPECT OF ANY GOODS, PRODUCTS, SERVICES, BENEFITS OR OFFER, CASHBACK/ GRATIFICATION/ AWARDS ACQUIRED OR OBTAINED THROUGH THE OFFERS OR ANY TRANSACTIONS EFFECTED THROUGH THE OFFERS; (B) THE PARTICIPANT EXPRESSLY AGREE AND ACKNOWLEDGE THAT PARTICIPATION IN THE OFFER IS ENTIRELY AT HIS/HER SOLE RISK AND DISCRETION AND IS GOVERNED STRICTLY BY THE TERMS AND CONDITIONS DETAILED HEREIN; AND (C) NO ADVICE, COMMUNICATION OR INFORMATION WHETHER BY REPRESENTATIONS, ORAL, WRITTEN OR PICTORIAL DERIVED OR OBTAINED FROM OR THROUGH THE PAYTM PLATFORMS INCLUDING BUT NOT LIMITED TO WEBSITES/ SMS, OR ANY OTHER MEDIUM, SHALL BE CONSTRUED TO MEAN THE GIVING OF ANY WARRANTY OF ANY KIND WHATSOEVER, UNLESS EXPRESSLY STATED IN WRITING. NEITHER BIKAJI, NOR PAYTM SHALL BE DEEMED TO MAKE ANY COMMITMENT OR WARRANTY, COMMITMENT, UNDERTAKING OR ASSURANCE, EXPRESS OR IMPLIED TO RESPOND TO ANY FEEDBACK, SUGGESTION AND/OR QUERIES OF THE PARTICIPANT(S).
The Cashback to the Participants shall be given subject to strict compliance with all applicable statutory legislations and laws, processes and formalities in connection with the Cashback and upon production or submission of all such documents/papers, information or declaration, as may be required by Bikaji and/ or Paytm, at their sole discretion, for the purpose of verification, validation or audit. Any failure on the part of the Participant(s) to comply with directions, instructions or requirements issued by Bikaji and/ or Paytm for claim of Cashback shall result in automatic disqualification from the Offer and entitle Paytm to forfeit the Cashback or Bikaji and/ or Paytm shall also be entitled to roll over the unclaimed Cashback to the next eligible Participants(s) or cancel the same entirely, at their sole discretion, without any liability or obligation, and such decision shall be final and binding.
The Cashback offered under this Offer is neither assignable, nor transferable and cannot be exchanged for cash or any other benefit, in any form, under any circumstance, unless specifically provided hereunder. No request for transfer or assignment of Cashback under this Offer will be entertained, under any circumstances. All the cashbacks shall be subject to such other T&C as may be applicable to specific cashback, which shall be binding on the Participant(s) and shall have to be duly complied with by the Participant(s). The Participant(s) shall be solely responsible for ensuring full compliance with such terms and conditions, and neither Bikaji, nor Paytm shall be liable for any forfeiture or denial of Cashback under this Offer, arising from the Participant’s non-compliance.
Participant(s) are subject to verification, including without limitation, verification of eligibility through checks as deemed appropriate by the Paytm to ensure complete compliance with the Offer’s terms and conditions. Paytm reserves the right to verify the Participant’s details either on their own or through its authorized agency / person and the Participant shall co-operate and provide all necessary assistance in such verification. In exercising this right, Paytm may ask the Participant to provide any documentary or other form of evidence regarding the information submitted by Participant at the time of registration, and if such evidences fail to substantiate the information provided by the Participant to Paytm, then Paytm, in consultation with Bikaji, shall have the right to disqualify the Participant without any liability.
The Participant’s hereby expressly agree, undertake and acknowledge that it shall not hold the Bikaji and/ or Paytm and/or any of their group entities or affiliates, their respective directors, officers, employees, agents or representatives responsible for or liable for, in any manner, whatsoever, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or indirect or consequential or incidental or remote that they may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and/ or on account of this Offer. This includes, not limited to, any delay, error, omission, technical failure or inability to avail or redeem the Offer or Cashback. The Participant further waives any right to raise any claim, demand or proceeding against the Organizers in respect of any such alleged loss or damage and agrees to indemnify and keep indemnified the Organizers against any costs or consequences arising from any breach of these terms and conditions.
Any Participant providing any false, incorrect, misleading or incomplete information or concealing/withholding any material information from Paytm and/ or Bikaji, in connection with the Offer, with intent to participate and/or be chosen as the Participant(s) of the Offer, will be automatically disqualified from participating in the Offer and being chosen as the Participant(s) of the different categories of cashback. Such act of providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile connection of Operator number, domicile, etc., by the Participant or any dispute with the Paytm, shall entitle Paytm upon receiving written instructions from Bikaji, to disqualify him/her without any further intimation. Both Bikaji and Paytm reserves the right to take appropriate legal and remedial action against any Participant found to be involved in illegal/ fraudulent/ unauthorized/ unlawful activity in connection with the Offer.
Paytm’s Platform and the provision of the Offer is available on an ‘as is where is available’ basis and Paytm makes no representation, guarantee or warranty regarding the availability, fitness for any specified purpose or error free operation of the Paytm Platform. Paytm Platforms’ availability may be affected due to various reasons including force majeure, acts of God, change in guidelines of Govt agencies/ authorities, regulatory directions/ instructions/ ruling, inclement weather, topographical/ geographic/ demographic factors, maintenance work, availability of interconnection with other networks, network issues, etc.
Paytm and Bikaji jointly reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this Offer or any part thereof including the eligibility criteria, the Offer T&C and structure or value of cashback, at their mutual discretion, at any time during the validity of Offer, in whole or in part, as may be required including in view of business exigencies and/or changes by a legal or regulatory authority and/or statutory changes and/ or directives from statutory or judicial authorities and/or any other circumstances or reasons beyond their control and the same shall be final and binding on all the Participants. Paytm and Bikaji further reserves all the joint rights to offer any amount/coupon/voucher/any other cashback equivalent to the value of cashback, at their mutual discretion. No queries/complaints whatsoever in this regard shall be entertained, either by Paytm or Bikaji.
The Participants hereby agrees that it shall fully indemnify, defend and hold harmless and keep indemnified Paytm, Bikaji and their respective officers, directors, employees, customers, and affiliates, group companies, agents and representatives from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, penalties, expenses and costs (including reasonable attorney’s fees and court/ legal costs) which may arise, incur, payable or become responsible as sponsor/organizer/facilitator as a result of: (i) any breach or alleged breach of the representations, warranties, covenants or obligations by the Participants under the T&C stated hereunder; (ii) any violation or failure by the Participants to comply with applicable laws, rules and regulations; and (iii) any third party claim, arising in respect of misuse of any information of a third party by the Participant or unauthorized disclosure, or infringement of any proprietary or personal information, by the Participant. Bikaji and Paytm shall have the unfettered right to defend themselves, and control of any matter, pursuant to this clause, at the sole cost and expenses of the Participants. Under no circumstance, Bikaji, Paytm or their respective affiliates shall be liable or responsible for any direct, indirect, incidental, special, punitive, exemplary or consequential damages, including loss of business, profits, or goodwill, whether foreseeable or not, arise or incurred by the Participant(s) or any third party, in connection with the Offer.
Paytm and/or Bikaji or its respective affiliates or associates or agents, directors, officers or employees shall not be responsible or liable, in any manner, whatsoever, to any Participant/Participant(s) or any third party, for any direct and/ or indirect losses, damages, costs or claims or liabilities of whatsoever nature, arising out of or in connection with this Offer, including: (1) incidental, indirect, special, punitive, exemplary or consequential damages, loss of profits, goodwill, data, technical or system errors or failures, mobile connectivity, application glitches, delay, interruption or failure in sending or receiving the SMS or any other communication to the Participants, or any action that has been initiated, actioned or completed through Participants’ mobile phones, failure of servers or the failure to provide the updates or any failures arising out of technical snags or resultant inability of the Participant(s) to view or observe the Offers or T&C; or (2) any personal loss or injury or damage that may be suffered (including loss of life) by a Participant(s) and/or any third party, directly or indirectly, by use or non-use of the Offer or redemption of Cashback or use of Paytm Platform or Product purchased or booked through Paytm Platform. Neither Paytm, nor Bikaji shall be liable for any claims arising due to actions initiated or completed through the Participant’s mobile device or due to any factors beyond their reasonable control including force majeure, regulatory changes or third-party actions.
Apart from the Offer and Cashback, and benefits explicitly detailed under this Offer, the Participants or their legal heirs/ successors/ representatives/ assigns shall have no other rights or claims or entitlements, of any nature, whatsoever, against the Bikaji and/or Paytm and their respective affiliates, agents, etc. The Offer does not confer any additional obligations, warranties, assurances or liabilities on the part of Bikaji or Paytm beyond those expressly stated herein.
All incidental costs, taxes, charges or levies related to or arising from the cashback(s), if any, or participation in the Offer shall be entirely and exclusively borne by the Participant in reference to this offer only, including but not limited to TDS, gift tax (if any), Insurance and any other taxes applicable by the Central, State or Municipal government. Neither Bikaji nor Paytm shall be responsible for any tax implications that may arise from the Cashback or other benefits under this Offer.
There can be certain stock of Bikaji’s Promotional Product Packs featuring the Offer may continue to be available even after the Offer Period. Participants acknowledge and agree that participation in the Offer is only permitted within the specified Offer Period and further, agree not to raise any claim or complaint against Bikaji and/or Paytm, their affiliates or agents regarding same.
This Offer is subject to force majeure circumstances including without limitation, natural calamities, floods, natural disasters, war, and act of terror, political unrests, technical snags, act of God, change of laws, judicial or quasi-judicial orders or technical errors or failure, system error, computer viruses, tampering, unauthorized intervention, interception, fraud, technical failures, epidemic, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, change in guidelines of government agencies/authorities, regulatory directions/instructions/ruling, inclement weather, topographical/ geographic/ demographic factors, maintenance work, unavailability of interconnection with other networks, network issues or disruptions or any circumstance beyond the control of Paytm and/ or Bikaji (“Force Majeure Event”). Neither Bikaji, nor Paytm shall be liable for any delay, interruption, failure, loss or adverse effect or failure or breach or damages or act or omission caused to this Offers or Participant(s) as a result of a Force Majeure Event. In such cases, both Paytm and Bikaji shall have the sole discretion to modify, suspend or cancel the Offer, wholly or partly, without any obligation to compensate any Participant or third-party.
Paytm and/ or Bikaji shall not be responsible or liable for system outages, server delays, equipment malfunctions, technical or network errors or data loss of any kind, lost or unavailable connections or other technical difficulties or any other force majeure event that may prevent a Participant from accessing or participating in the Offer. Also, neither Paytm, nor Bikaji shall be liable for any consequences arising due to such events and the Participant acknowledges that such events may occur due to reasons beyond the control of Paytm and/ or Bikaji and both shall stand indemnified against any claim, loss or damage arising therefrom.
Failure by either Bikaji or Paytm to enforce any of their respective rights, under these terms, at any stage does not constitute a waiver of those rights. Also, any relaxation or delay in enforcement shall not be deemed as a continuing waiver or precedent. Bikaji and/ or Paytm may assign any of its rights hereunder to any party, after informing the other Party, in writing, without prior intimation to Participant(s). Participant(s) shall not assign or transfer any of their rights or obligations hereunder to any other party and any such purported assignment by Participant(s) shall be null and void and not binding on Paytm and/ or Bikaji.
If any terms and conditions of the Offer are found to be invalid or for any reason unenforceable, then that provision will be deemed severable from these terms and conditions and will not affect the validity and enforceability and legality of any remaining provisions.
The decision of Bikaji and Paytm, jointly, on all aspects of the Offer, including with regard to administering, eligibility criteria and interpretation of the campaign/ offer shall be final and binding on all the Participants. No challenge or dispute by any Participant shall be entertained without mutual written agreement of both Paytm and Bikaji, and neither party shall be held solely responsible for any decision taken without such consultation.
All content, trademarks, copyrights, logos, creatives and other intellectual property associated with this Offer belongs exclusively to the Bikaji and/ or Paytm. Any unauthorised use, reproduction or imitation by any Participant is strictly prohibited and will be treated as an infringement of rights, attracting legal action and claims for losses. The Bikaji and/ or Paytm reserves all rights in this regard.
Paytm, upon written instructions of Bikaji, reserves the right to forfeit the cashback or to disqualify or to declare any Participant ineligible, at any stage of the Offer, in the event of failure or breach or non-adherence to the T&C or applicable law by the Participant.
These T&C of the Offer are the extension of the Paytm and Bikaji policies/terms and conditions for this Offer mentioned on the Paytm Platform and Bikaji. In the event of any conflict or inconsistency between any instructions, rules, marketing content, promotional material and terms and conditions on any advertising or promotional material relating to the Offer, these T&C shall prevail over all such other instructions, rules, marketing content, promotional material and terms and conditions or any other document or agreement.
This Offer and its T&C’s shall be governed by and construed to in accordance with the Indian laws and all the disputes or differences arising out of or in connection with this Offer, including its interpretation, validity, enforceability or rights and obligations of Participants, Paytm and/or BIKAJI, shall be subject to the exclusive jurisdiction of the competent Courts at New Delhi. Participation in this Offer is unauthorized in any jurisdiction that does not give effect to all provisions of these T&C’s. BIKAJI and Paytm expressly reserve the right to take appropriate legal remedy, in case of any misuse, non-compliance or breach of these T&C’s and no provision herein shall be deemed to limit either party’s legal remedies.
